TERMS OF USE

1. About These Terms

These Terms of Use ('Terms') govern your access to and use of the music and sound design catalogue provided by Hundred Hand Slap ('we', 'us', 'our'), accessible at www.hundredhandslap.com/musiclibrary ('the Library').

By downloading, streaming, synchronising, or otherwise using any audio content from the Library, you ('the Licensee') agree to be legally bound by these Terms in full. If you do not agree, you must not use any content from the Library.

We reserve the right to update these Terms at any time. Continued use of the Library following any update constitutes acceptance of the revised Terms. It is your responsibility to review this page regularly.

 

2. Intellectual Property

All music, sound design, compositions, recordings, and associated materials within the Library are the exclusive intellectual property of Hundred Hand Slap and are protected by UK and international copyright law, including but not limited to the Copyright, Designs and Patents Act 1988.

No ownership or copyright is transferred to the Licensee under any circumstances. All rights not expressly granted under these Terms are reserved by Hundred Hand Slap.

 

3. Licence Grant

3.1 General Licence

Subject to compliance with these Terms, Hundred Hand Slap grants you a limited, non-exclusive, non-transferable, revocable licence to use content from the Library solely for the purposes specified below and in accordance with the applicable licensing route.

3.2 Permitted Uses — PRO-Reported Broadcast and Editorial Content

Music and sound design from the Library may be used in the following contexts, provided all usage is properly logged and reported via the relevant national Performing Rights Organisation (PRO) or equivalent collecting society:

  • Television programmes, films, and online video content produced for broadcast or streaming platforms

  • Radio broadcast (including terrestrial, digital, and online radio services)

  • Corporate video, branded content, and promotional material (excluding paid advertising — see Section 4)

  • Video games, interactive media, and e-learning content

  • Documentary, educational, and factual productions

  • Theatre, live events, and public performance (where appropriate PRO licensing is in place)

 

In all cases, the Licensee or the relevant production company must ensure that cue sheets detailing every use of Hundred Hand Slap content are accurately completed and submitted to the appropriate broadcaster or PRO, including but not limited to:

  • PRS for Music / MCPS (United Kingdom and Ireland)

  • ASCAP, BMI, or SESAC (United States)

  • SOCAN (Canada)

  • GEMA (Germany)

  • SACEM (France)

  • APRA AMCOS (Australia and New Zealand)

  • Your local PRO or equivalent collecting society in all other territories

 

Failure to submit accurate cue sheets or usage reports constitutes a breach of these Terms and may result in termination of your licence and/or legal action.

 

4. Advertising and Podcast Use — Mandatory PRS / MCPS Licence

Use of any music or sound design from the Library in the following contexts requires a specific licence obtained directly through PRS for Music / MCPS (in the UK and Ireland), or via the appropriate equivalent body in your territory, prior to use:

  • Any paid advertising, commercial, or promotional spot (television, radio, online, or out-of-home)

  • Podcast episodes and audio series distributed publicly, whether monetised or not

  • Radio broadcast content

  • Point-of-sale audio or in-store background music

 

In the UK, Licensees should obtain their licence via the MCPS Licence Manager at www.prsformusic.com or by contacting the PRS for Music licensing team at applications@prsformusic.com or on +44 (0)20 3741 3888. Independent production companies should consider applying for an IPC (Independent Production Company) Licence.

Licensees outside the UK should contact their local PRO or collecting society to obtain the appropriate synchronisation and/or broadcast licence before using Library content.

Use in advertising or podcasts without obtaining the appropriate licence in advance is strictly prohibited and constitutes a material breach of these Terms.

 

5. Sound Design — Specific Restrictions

In addition to the general Terms set out above, the following restrictions apply specifically to all sound design content within the Library:

  • Sound design assets may not, under any circumstances, be repackaged, recompiled, redistributed, or resold as part of another production music library, sound effects library, sample pack, audio toolkit, or similar commercial product — whether in modified or unmodified form.

  • Sound design may not be licensed on to third parties or sub-licensed in any form.

  • Sound design assets must not be passed off as the original work of the Licensee or any third party.

  • Use of sound design in broadcast, film, advertising, and podcast content is subject to the same PRO reporting and licensing requirements described in Sections 3 and 4 above.

 

Any breach of this section will be treated as a serious infringement of copyright and Hundred Hand Slap reserves the right to pursue all available legal remedies, including injunctive relief and financial damages.

 

6. Prohibited Uses

Unless expressly permitted by a separate written agreement with Hundred Hand Slap, the following uses are strictly prohibited:

  • Claiming authorship, ownership, or copyright in any Library content

  • Registering Library content with any PRO, collecting society, or rights management organisation as your own composition or recording

  • Using Library content in content that promotes hatred, discrimination, illegal activity, or material harmful to minors

  • Making Library content available for third-party download or redistribution

  • Uploading Library content to royalty-free platforms, stock audio marketplaces, or content-ID claiming services

  • Using Library content as stems, samples, or loops in music production without prior written consent

 

7. Usage Logging and Reporting Obligations

All use of content from the Library must be logged and reported. This is a fundamental condition of your licence. Specifically:

  • You must ensure that all uses of Library music and sound design are accurately documented in a cue sheet or equivalent usage log.

  • Cue sheets must be submitted to the relevant broadcaster, platform, or PRO as required by your production type and territory.

  • Upon request, you must provide Hundred Hand Slap with evidence of your usage reporting, including copies of submitted cue sheets.

  • Where a production is distributed across multiple territories, it is your responsibility to ensure that usage is reported to all relevant PROs in each territory of distribution.

 

Hundred Hand Slap retains the right to audit use of its content and to take appropriate action where usage has not been properly reported.

 

8. Royalties and Payments

Performance royalties arising from broadcast and public performance of Library content are collected on behalf of Hundred Hand Slap by its registered PROs and affiliated collecting societies. The Licensee does not pay these royalties directly to Hundred Hand Slap; they are distributed via the PRO system based on the cue sheets you submit.

For uses requiring a direct synchronisation or mechanical licence (such as advertising or podcasts as described in Section 4), fees are payable according to the applicable PRS / MCPS rate card or the rate card of the relevant international body. Hundred Hand Slap receives its share of these fees via its PRO membership.

No additional 'royalty-free' buyout is offered by Hundred Hand Slap. All use of Library content is subject to the PRO licensing and reporting framework described in these Terms.

 

9. Term and Termination

Your licence to use content from the Library continues for as long as you remain in compliance with these Terms. Hundred Hand Slap reserves the right to terminate your licence immediately and without notice if you breach any provision of these Terms.

Upon termination, you must immediately cease all use of Library content and, where possible, remove any Library content from productions not yet distributed. Licences already properly obtained through a PRO prior to termination remain valid for the specific use licensed.

 

10. Warranties and Representations

You represent and warrant that:

  • You have the authority to enter into and be bound by these Terms

  • You will use Library content only in accordance with these Terms and all applicable laws

  • You will obtain all necessary licences from the relevant PRO or collecting society before using Library content in advertising or podcast productions

  • You will accurately complete and submit all cue sheets and usage reports as required

 

Hundred Hand Slap warrants that it owns or controls the rights to all content in the Library and that use of Library content in accordance with these Terms will not infringe the rights of any third party.

 

11. Indemnity

You agree to indemnify, defend, and hold harmless Hundred Hand Slap and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of Library content in breach of these Terms

  • Your failure to obtain the required PRO or collecting society licence for advertising or podcast use

  • Your failure to submit accurate cue sheets or usage reports

  • Any misrepresentation made by you in connection with your use of the Library

 

12. Limitation of Liability

To the fullest extent permitted by law, Hundred Hand Slap shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Library. In no event shall Hundred Hand Slap's total liability to you exceed the licence fees actually paid by you (if any) in the twelve months preceding the claim.

 

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
